The Capacity of an adult refers to their mental state. An executor or Administrator must have full mental capacity as defined by the Mental Capacity Act in order to fulfill their role.
A beneficiary of an estate must have mental capacity in order to receive a gift.
The mental Capacity act 2005 states that an adult must be presumed to have mental capacity unless it can be proved otherwise.
If doubts exists as the mental Capacity professional advice should be sought. it may be necessary to prepare a Power of attorney, Lasting power of attorney or apply for a Court of protection order (deputyship) dependant on the circumstances
