Living Wills/Lasting Power of Attorney 


Also known as "Advanced Directives", not particularly nice reading, Living Wills are used for those who do not wish to be resuscitated or revived under certain prevailing serious medical conditions. These are similar to Wills in that they have to be Witnessed and can be revoked at any time, although they do not generally need to be updated. Living Wills are generally written at the same time that you make a will.
 
 
The Living Will has now been replaced by the more secure but more complex Lasting Power of Attorney also known as LPA. There are now two type of Lasting Power of Attorney, there is the Lasting Power of Attorney that deals with your medical and health situation and the Lasting Power of Attorney that deals with all financial matters. Enduring/Lasting Power of Attorney

What is a Lasting Power of Attorney. In the event of Mental illness preventing you from dealing with your own financial affairs the Lasting Power of Attorney for financial or the Lasting Power of Attorney for medical affairs or if you wish to discuss your current enduring power of attorney. Lasting Power of Attorney documents are used by your family or loved ones to take over that responsibility. The Lasting Power of Attorney can not enforced until any such illness occurs and even then, they are totally secure because members of your family have to be informed that the Lasting Power of Attorney is to be registered.
 
 
The Lasting Power of Attorney document then has to be lodged with the Court of Protection. Please note the Enduring Power of Attorney has now been replaced by the more secure but more complex Lasting Power of Attorney.
