When obtaining probate
a Grant of Probate or Letter of Administration the Estate Administrator or Executor needs to first obtain details relating to the deceased's assets. This must include all assets in joint names with another person and all assets in their sole name. This is because in order to obtain a grant of probate
the Inland Revenue need to ensure that there is no inheritance tax to pay, in addition they need to ensure that the deceased's person's personal income tax affairs are finalised.

Obtain a Grant of Probate
Once the estate has been compiled the details must be entered into either form IHT205 or the series of forms known as IHT400. When completing form IHT205 there are certain questions that, depending on the answer, will direct you to form IHT400. Once these have been completed you will next need to complete form PA1. Once you have attended the court where you will be asked to swear an oath you will then be in a position to have probate granted. You will have now successfully obtained probate. Unfortunately this is only a small part of the process, now begins the more complex part where you must collect the assets, confirm identity of beneficiaries and ensure none are bankrupt. You must prepare estate tax returns if necessary, collate estate accounts and be held accountable to the beneficiaries.
