Wills and Probate

Probate is the legal process to deal with the administration of deceased persons estate. When a person dies that has made a will it is not definite that you need to probate a will. Some estates may not need probate. Wills and probate can be very confusing. The person or persons who have been appointed as Executors must still carry out administration of the estate regardless of whether probate of a will is necessary.

Executor Duties

The duties of an Executor are quite extensive. The first thing to establish, after arrangements of the funeral, is will probate be required. Once this has been decided it is then necessary to choose whether to act in a personal capacity or will probate specialists such as ourselves be required. How to probate a will?

If you have decided you will probate the estate, the first step will be to compile the assets and liabilities of the deceased. Once you have obtained all the values necessary to complete the probate forms you need to complete either form IHT205 or IHT400 as necessary. The liabilities of the executor are quite considerable, once you have intermeddled in the estate as an executor you are not permitted to stop therefore before making your final decision please call our wills and probate help line.
